1. About These Terms

These Job Seeker Registration Terms and Conditions ("Terms") govern your registration with Medfuture Pty Ltd ("Medfuture", "we", "us" or "our") as a job seeker or candidate.

These Terms apply whether you register:

  • through the Medfuture website;
  • through a Medfuture registration form or portal;
  • by email or telephone;
  • through a Medfuture consultant;
  • through a job board, professional platform or other authorised recruitment channel;
  • through a referral;
  • at an event or recruitment campaign; or
  • by any other method through which you request Medfuture's recruitment or career placement services.

By ticking "I agree to the Medfuture Job Seeker Registration Terms and Conditions", signing a registration form, or otherwise expressly accepting these Terms, you enter into an agreement with Medfuture on these Terms.

2. Medfuture's Role

Medfuture is a medical and healthcare recruitment agency that assists candidates and employers with recruitment, placement and workforce services.

Medfuture may assist candidates seeking opportunities including permanent, fixed-term, temporary, locum, contract, sessional and other healthcare engagements.

Our services may include:

  • identifying potentially suitable employment opportunities;
  • discussing your experience, qualifications and career preferences;
  • matching your profile against employer requirements;
  • presenting or submitting your candidacy to employers with your authority;
  • arranging interviews;
  • facilitating communications between you and prospective employers;
  • assisting with employment negotiations;
  • coordinating credentialing and compliance requirements;
  • conducting or coordinating reference checks;
  • providing general information concerning registration, relocation, immigration or onboarding processes; and
  • maintaining your candidate profile for future opportunities.

Unless expressly stated otherwise in writing, Medfuture is acting as a recruitment intermediary and is not your employer, prospective employer, legal adviser, migration adviser, financial adviser or professional registration authority.

3. No Guarantee of Employment

Registration with Medfuture does not guarantee:

  • employment;
  • an interview;
  • submission to an employer;
  • any particular salary, hourly rate or remuneration;
  • a particular location or roster;
  • visa approval;
  • professional registration;
  • Medicare eligibility;
  • provider number approval;
  • credentialing;
  • employment sponsorship;
  • suitability for a particular position; or
  • that an advertised position will remain available.

Recruitment and appointment decisions ultimately remain subject to the requirements and decisions of the relevant employer and, where applicable, regulatory, registration, immigration, credentialing and government authorities.

Medfuture will not make a representation that employment, registration, immigration approval or any other outcome is guaranteed where that outcome depends upon a third party.

4. Candidate Eligibility and Information

When registering with Medfuture, you agree to provide information that is, to the best of your knowledge:

  • true;
  • accurate;
  • complete;
  • current; and
  • not misleading.

You must notify Medfuture within a reasonable period if information relevant to your candidacy materially changes.

Depending on the position, Medfuture may request information or documentation including:

  • full name and contact information;
  • curriculum vitae;
  • employment history;
  • qualifications;
  • professional registration details;
  • AHPRA or other regulatory registration information;
  • professional memberships;
  • specialist or college recognition;
  • training and accreditation information;
  • references;
  • identity documents;
  • evidence of work rights;
  • visa or immigration status;
  • Medicare/provider number information where relevant;
  • police or background checks where lawfully required;
  • Working With Children or vulnerable-person checks where applicable;
  • immunisation or health-related compliance information where lawfully required for a role;
  • credentialing documents;
  • continuing professional development information;
  • professional indemnity insurance information where applicable; and
  • other information reasonably necessary to assess your suitability for employment.

You must not knowingly provide false, forged, altered, incomplete or misleading documentation.

5. Professional Registration and Credentials

Where a position requires professional registration, licensing, accreditation, credentialing, membership or certification, you are responsible for maintaining all requirements necessary to lawfully undertake the position.

For healthcare professionals, this may include requirements imposed by bodies or organisations such as:

  • the Australian Health Practitioner Regulation Agency (AHPRA);
  • relevant National Boards;
  • specialist medical colleges;
  • Medicare;
  • Services Australia;
  • health departments;
  • hospitals and health services;
  • accreditation bodies; and
  • other relevant authorities.

You authorise Medfuture to verify professional registration and other publicly available professional information where reasonably necessary for recruitment or compliance purposes.

6. Right to Work in Australia

You must have, or become eligible to obtain, appropriate legal authority to work in Australia before commencing any employment or engagement.

Medfuture may request evidence of your:

  • Australian citizenship;
  • permanent residency;
  • visa;
  • work rights; or
  • other lawful entitlement to work.

Where legally permissible, Medfuture may verify relevant work-right information.

Medfuture does not guarantee that any employer will sponsor a candidate or that any visa or immigration application will be approved.

Any migration assistance requiring the services of a registered migration agent or Australian legal practitioner must be provided by an appropriately authorised person.

7. Authority to Represent and Submit Your Candidacy

Registering with Medfuture authorises Medfuture to identify, discuss and recommend employment opportunities that may be relevant to you.

Registration alone does not give Medfuture unrestricted authority to send your identifiable CV or application to any employer.

Before Medfuture formally submits or presents your identifiable candidacy to a particular prospective employer, Medfuture will ordinarily obtain your authority for that submission, which may be provided verbally, electronically or in writing and recorded by Medfuture.

Your authority may identify:

  • the employer;
  • the position;
  • the location;
  • a category of related vacancies with that employer; or
  • another clearly described recruitment opportunity.

Once you authorise a submission, Medfuture may provide information reasonably necessary for the recruitment process to that prospective employer.

8. Duplicate Representation

You must inform Medfuture if:

  • you have already applied directly to an employer for a position Medfuture discusses with you;
  • another recruitment agency has already submitted you for the same position;
  • another person or organisation is representing you for the same opportunity; or
  • you are already in active discussions with that employer regarding the same or substantially similar position.

This assists Medfuture, you and prospective employers in avoiding duplicate candidate submissions and disputes concerning candidate representation.

Nothing in these Terms prevents you from seeking employment independently or using another recruitment agency unless you separately enter into a lawful written exclusivity arrangement with Medfuture.

9. Interviews and Employer Communication

If Medfuture arranges an interview, meeting or employer discussion, you agree to make reasonable efforts to:

  • attend at the agreed time;
  • provide reasonable notice if you cannot attend;
  • communicate professionally;
  • provide accurate information; and
  • promptly inform Medfuture of material developments concerning the recruitment process.

You remain free to accept or reject any employment opportunity presented through Medfuture.

10. Offers of Employment

Any employment offer is subject to the terms offered by the prospective employer.

Before accepting an offer, you should review matters relevant to you, which may include:

  • remuneration;
  • hours;
  • roster;
  • location;
  • duties;
  • employment status;
  • applicable award or enterprise agreement;
  • leave and other entitlements;
  • probation;
  • notice requirements;
  • professional indemnity arrangements;
  • relocation;
  • visa or sponsorship conditions;
  • registration requirements; and
  • any other contractual conditions.

Unless Medfuture is itself the employing entity, the employment contract is between you and the employer, not Medfuture.

11. Candidate Fees

Unless Medfuture expressly agrees otherwise in writing and charging such a fee is lawful:

Medfuture does not charge a candidate a placement fee merely for registering with Medfuture or being introduced to an Australian employment opportunity.

Where an optional third-party service may involve a cost — for example, certain police checks, professional registration processes, migration services, medical examinations, document certification, credentialing, training or other external services — any applicable cost should be separately disclosed before the candidate incurs it.

Medfuture will comply with applicable Commonwealth, State and Territory laws governing fees and charges connected with employment placement services.

12. References and Background Checks

Where reasonably necessary for a position and subject to applicable law, Medfuture may request your consent to:

  • contact referees;
  • verify employment history;
  • verify qualifications;
  • verify professional registration;
  • conduct or arrange compliance checks;
  • verify work rights;
  • verify professional memberships or accreditations; and
  • obtain other lawful pre-employment information.

You confirm that where you provide another person's contact details as a referee, you have a reasonable basis for providing those details for reference-checking purposes.

A referee's information will be handled in accordance with applicable privacy requirements.

13. Privacy and Personal Information

Medfuture handles personal information in accordance with applicable Australian privacy laws and Medfuture's Privacy Policy.

Personal information collected during recruitment may include:

  • identification and contact information;
  • employment history;
  • qualifications;
  • professional registration;
  • CV and application information;
  • references;
  • work-right information;
  • remuneration expectations;
  • employment preferences;
  • interview information;
  • communications with Medfuture;
  • compliance and credentialing information; and
  • other information reasonably required for recruitment purposes.

You should read Medfuture's Privacy Policy before registering.

14. Sensitive Information

Certain recruitment processes may require Medfuture to collect information classified as sensitive information under Australian privacy law.

This may include, where relevant and lawful:

  • health information;
  • professional association or membership information;
  • criminal history information;
  • disability-related information;
  • immunisation information; or
  • other information treated as sensitive information by applicable privacy legislation.

Medfuture will only collect sensitive information where permitted by law and, where required, with your consent.

By separately consenting to the collection of sensitive information requested as part of a relevant recruitment, credentialing or compliance process, you authorise Medfuture to collect, use and disclose that information for the purposes explained to you.

15. Use of Personal Information

Subject to applicable law and Medfuture's Privacy Policy, Medfuture may use your personal information for purposes including:

  • registering you as a candidate;
  • assessing your skills and experience;
  • candidate-to-vacancy matching;
  • communicating employment opportunities;
  • recruitment and placement activities;
  • employer introductions authorised by you;
  • arranging interviews;
  • credentialing;
  • compliance;
  • reference checking;
  • work-right verification;
  • onboarding;
  • maintaining candidate records;
  • improving recruitment services;
  • responding to enquiries;
  • managing complaints;
  • fraud and security prevention; and
  • satisfying legal and regulatory obligations.

16. Disclosure of Personal Information

Where reasonably necessary and authorised or otherwise permitted by law, Medfuture may disclose relevant personal information to parties such as:

  • prospective employers;
  • hospitals;
  • medical centres;
  • healthcare organisations;
  • aged-care providers;
  • allied health organisations;
  • credentialing organisations;
  • professional registration bodies;
  • government agencies;
  • background-check providers;
  • technology and recruitment-platform providers;
  • professional advisers;
  • related entities and service providers; and
  • other parties involved in an authorised recruitment or onboarding process.

Medfuture will seek to limit disclosures to information reasonably necessary for the relevant purpose.

17. Overseas Processing and Cross-Border Disclosure

Medfuture may use personnel, related entities, contractors, technology providers or service providers located outside Australia to support recruitment and administrative activities.

This may result in personal information being accessed, processed or disclosed outside Australia.

Where Australian privacy law applies to a cross-border disclosure, Medfuture will take steps required by applicable law in relation to that disclosure.

Medfuture's Privacy Policy should identify, where practicable, the countries in which overseas recipients are likely to be located.

18. Data Security

Medfuture will take reasonable steps required by applicable privacy law to protect personal information it holds from:

  • misuse;
  • interference;
  • loss;
  • unauthorised access;
  • unauthorised modification; and
  • unauthorised disclosure.

No internet-based or electronic information system can be guaranteed to be completely secure.

Candidates should therefore use reasonable care when transmitting identity documents or other sensitive information electronically.

19. Access and Correction

Subject to applicable law, you may request access to personal information Medfuture holds about you and request correction of information that is inaccurate, out of date, incomplete, irrelevant or misleading.

Requests should be made using the privacy contact details contained in Medfuture's Privacy Policy.

Certain lawful exceptions may apply.

20. Retention and Deletion of Candidate Information

Medfuture may retain candidate information for as long as reasonably necessary for:

  • recruitment;
  • future employment opportunities;
  • candidate relationship management;
  • compliance;
  • dispute management;
  • legal obligations; and
  • legitimate business recordkeeping purposes,

subject to applicable law.

You may ask Medfuture to deactivate your candidate profile or request deletion of personal information.

Where Medfuture is legally required or otherwise permitted to retain particular information, Medfuture may retain that information notwithstanding a deletion request.

21. Future Job Opportunity Communications

By registering as a job seeker, you request Medfuture to contact you regarding recruitment opportunities, application updates and other communications reasonably connected with providing recruitment services to you.

These recruitment-service communications are distinct from general promotional or marketing communications.

You may ask Medfuture to stop contacting you about future employment opportunities or deactivate your candidate profile at any time.

22. Marketing Communications

Consent to receive general Medfuture marketing communications is optional and is not a condition of registering as a job seeker.

Where you separately consent, Medfuture may send you relevant promotional communications, industry updates, newsletters, events, campaigns and information concerning Medfuture services.

You may withdraw marketing consent at any time using an available unsubscribe facility or by contacting Medfuture.

Withdrawing marketing consent does not automatically cancel your candidate registration or prevent Medfuture from sending communications necessary to administer an active recruitment process.

23. Third-Party Services

Medfuture may provide information about third-party services that may assist a candidate, including services relating to:

  • immigration;
  • relocation;
  • accommodation;
  • registration;
  • credentialing;
  • professional development;
  • police checks;
  • insurance; or
  • other employment-related services.

Unless expressly stated otherwise, third-party providers operate independently from Medfuture.

You are responsible for deciding whether to engage a third-party provider.

Medfuture does not guarantee the services or decisions of an independent third party.

24. Non-Discrimination

Medfuture is committed to conducting recruitment activities consistently with applicable Australian workplace and anti-discrimination laws.

Candidate assessment and matching may legitimately consider matters relevant to the inherent requirements of a position, including qualifications, experience, registration, work rights, credentialing and other lawful occupational requirements.

Medfuture does not intend to unlawfully discriminate against candidates on the basis of protected attributes.

25. Confidentiality

During recruitment, you may receive confidential information concerning a prospective employer or position.

You agree not to misuse confidential information provided to you where the information is clearly confidential or the circumstances reasonably indicate that it is confidential.

This does not prevent you from obtaining professional advice, complying with the law, exercising a workplace right, making a protected disclosure, or communicating with a regulator or government authority.

26. Candidate Responsibility for Decisions

You are responsible for independently considering whether a position is suitable for you.

Medfuture may provide recruitment-related information but you should obtain independent professional advice where appropriate regarding matters such as:

  • employment contracts;
  • taxation;
  • immigration;
  • professional registration;
  • relocation;
  • financial matters; or
  • legal rights.

27. Limitation of Medfuture's Role

To the maximum extent permitted by law, Medfuture is not responsible for decisions, acts or omissions of independent prospective employers or other third parties.

Medfuture does not warrant that:

  • every vacancy will remain available;
  • every employer will interview a candidate;
  • information supplied by an employer will never change;
  • a candidate will obtain employment;
  • a particular employment relationship will continue for a particular period; or
  • a third-party authority will approve an application.

Nothing in these Terms excludes, restricts or modifies any consumer guarantee, statutory right, remedy or liability that cannot lawfully be excluded, restricted or modified.

28. Employer Information

Information concerning employers, remuneration, rosters, benefits, locations and job conditions may be supplied to Medfuture by third parties.

Medfuture will take reasonable care in communicating recruitment information but candidates should verify material employment terms through the employer's formal employment offer or contract before accepting a position.

29. Terminating Your Registration

You may request that Medfuture deactivate your candidate registration at any time.

Medfuture may suspend or deactivate a candidate profile where reasonably necessary, including where:

  • information supplied is materially false or misleading;
  • fraudulent documentation is suspected;
  • professional registration has expired or been materially restricted;
  • required work rights are unavailable;
  • serious professional or compliance concerns arise;
  • the candidate materially misuses Medfuture's services; or
  • Medfuture is required to do so by law.

Where appropriate and lawful, Medfuture may retain records after deactivation in accordance with its Privacy Policy and legal obligations.

Medfuture will endeavour to investigate and respond to complaints within a reasonable period.

Privacy complaints may also be subject to rights available under applicable privacy legislation.

Nothing in these Terms prevents you from contacting an appropriate regulator or exercising any statutory right.

31. Changes to These Terms

Medfuture may update these Terms from time to time to reflect changes in:

  • legislation;
  • regulatory requirements;
  • recruitment practices;
  • technology;
  • privacy requirements; or
  • Medfuture's services.

The current version will be published on Medfuture's website with its effective date.

Where a change materially affects an existing candidate's rights or the purposes for which their information is used, Medfuture will take reasonable steps to provide appropriate notice or obtain further consent where required by law.

32. Severability

If any provision of these Terms is found to be invalid, unlawful or unenforceable, that provision will be read down to the extent reasonably possible.

If it cannot be read down, it will be severed without affecting the remaining provisions, to the extent permitted by law.

33. Governing Law

These Terms are governed by the laws applicable in the State or Territory with the closest connection to the recruitment services provided to you, together with applicable Commonwealth legislation.

Nothing in this clause is intended to deprive you of any mandatory protection or right available under applicable Commonwealth, State or Territory law.

34. Electronic Acceptance

You agree that acceptance of these Terms electronically — including by ticking an acceptance box on Medfuture's website or electronic registration system — constitutes your acceptance of these Terms.

Medfuture may record:

  • the date and time of acceptance;
  • the version of the Terms accepted;
  • the registration source;
  • relevant electronic transaction information; and
  • other information reasonably required to evidence your consent.

35. Candidate Declaration

By accepting these Terms, you confirm that:

  1. you have read and understood these Job Seeker Registration Terms and Conditions;
  2. the information you provide to Medfuture will, to the best of your knowledge, be true, accurate and not misleading;
  3. you understand Medfuture acts primarily as a recruitment intermediary;
  4. you understand registration does not guarantee employment;
  5. you understand Medfuture will ordinarily obtain your authority before submitting your identifiable candidacy to a prospective employer;
  6. you agree to notify Medfuture of material changes relevant to your candidacy;
  7. you acknowledge that Medfuture may verify information reasonably necessary for recruitment and compliance purposes;
  8. you acknowledge that your personal information will be handled in accordance with Medfuture's Privacy Policy and applicable law; and
  9. you agree to these Terms.
